Understanding Our Agreement: Exploring Terms & Conditions

This Terms of Use Agreement sets forth the standards of use of the MedicareInsurance.com Online Service (“MedicareInsurance.com,” or the “Site”). MedicareInsurance.com is owned and operated by Health Insurance Associates, LLC (hereinafter, the “Company,” or “Health Insurance Associates”), a licensed insurance agency (see Licensing). By using MedicareInsurance.com you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this Site. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall be active immediately upon being posted at MedicareInsurance.com. Your continued use of the Site after changes are posted constitutes an acknowledgment and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

1. Description of Service

MedicareInsurance.com is delivering Member with a range of information and resources relating to Medicare coverage, health, and wellness. There are articles, resources, images, and other content (“Content”) written by us or commissioned from writers; and content we have licensed from well-respected sources and/or partners. The Content we write and commission is written and reviewed by reputable sources before it is posted. Content provided by our partners is also, where appropriate, subject to review by the MedicareInsurance.com team before it is posted. Everything we offer on the Site is referred to in these Terms of Service collectively as “the Services.” Review our Privacy Policy for additional information on how we do business.

2. TPMO Disclaimer

We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options.

3. Federal contracting statement

Plans are insured or covered by a Medicare Advantage organization with a Medicare contract and/or a Medicare-approved Part D sponsor. Enrollment in the plan depends on the plan’s contract renewal with Medicare.

4. This Site Does Not Provide Medical Advice

The contents of MedicareInsurance.com, such as text, graphics, images, information obtained from MedicareInsurance.com’s licensors, and other material contained on the Site (“Content”) are for informational purposes only. This Site is a private website and is not, associated, endorsed, or authorized by the Social Security Administration, the Health Care Financing Administration, the Department of Health and Human Services, or the Centers for Medicare & Medicaid Services nor do we claim to be. This site contains basic information about Medicare, services related to Medicare, and services for people with Medicare.

The site is provided by Health Insurance Associates, LLC on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, Health Insurance Associates, LLC makes no representations or warranties of any kind, express or implied, regarding the use or the results of this Site or the information, content, materials, or products included in the Site in terms of its correctness, accuracy, reliability, or otherwise. All links to other websites are provided as a courtesy only and you expressly agree that the use of them is at your own risk. Health Insurance Associates, LLC shall have no liability for any interruptions in the use of this Site. Health Insurance Associates, LLC does not warrant that this Site, its servers, or e-mail sent from Health Insurance Associates, LLC are free of viruses or other harmful components. Health Insurance Associates, LLC disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Member agrees to indemnify and hold Health Insurance Associates, LLC, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or any other right of any person or entity.

9. Third-Party Sites

This Site may include links to other websites on the Internet that are owned and operated by other third parties. Although we may provide oversight of some content on certain third-party sites as required by our agreements with insurance companies or by applicable government regulations, you acknowledge that we are not responsible to you for the availability of, or the content located on or through, any third-party website. You should contact the website administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party websites is subject to the terms of use and privacy policies of each website, and we are not responsible therein. We encourage all Members to review said privacy policies of third-parties’ sites.

10. Governing Jurisdiction of the Courts

Our website is operated and provided in the State of Florida. As such, we are subject to the laws of the State of Florida, and such laws will govern this Agreement, and any dispute of any sort that might arise between Member and Health Insurance Associates, LLC, without giving effect to any choice of law rules.

11. Copyright and Trademark Information

All content included on this site, such as text, graphics, logos (including the MedicareInsurance.com logo), button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Real Time or its content suppliers and protected by the United States and international copyright laws.   • You may direct us not to sell or share your "personal information" ("Right to Opt-Out").
  • You may cancel promotional text messages at any time by replying STOP.
  • You may opt-out or unsubscribe from receiving email and other forms of communications from us by: (a) follow the instructions included in the applicable email message or other communication; or (b) email us at: support@MedicareInsurance.com. Notwithstanding the foregoing, we may continue to contact you for the purpose of communicating information relating to your request for our services, as well as to respond to any inquiry or request you make. To opt-out of receiving these transactional response-related messages from us, you must cease requesting and/or utilizing the sites and services and/or cease submitting inquiries to Company, as applicable.

Upon submission, you may be asked to verify your identity. If we are able to verify your request, we will respond within 45 days of your submission (or such additional time period as the law allows us).

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. If you are an authorized agent submitting a request on behalf of an individual, you must attach signed permission indicating that you are able to act on another person's behalf.

We do not discriminate against any individual who chooses to exercise any of the above rights. If you disagree with how we handled a request, you may appeal our decision by contacting us with the subject line "Appeal."

Protecting Your Information

We use reasonable and appropriate methods to protect your information. Please be advised, however, that no storage facility, technology, software, security protocols or data transmission over the internet or via wireless networks can be guaranteed to be 100% secure.

In compliance with applicable federal and state laws, we shall notify you and any applicable regulatory agencies in the event that we learn of an information security breach with respect to your personal information. You will be notified via email, letter, or phone call in the event of such a breach, if permitted by law.
